Episode 28: Your FMLA, Workers’ Compensation & Disability Questions Answered

If there is one thing I know about human resources, is that it is always changing every day. We are working in an industry that is a moving target. With business combined with people, it’s a guarantee that no two days are ever the same.

In the HR world, one area that is hard to keep up with is the employment law landscape and eligibility requirements especially in the areas that I call the Triple Threat which are ADA, FMLA and Workers’ Compensation. Employment law attorneys, Eric B. Meyer (@Eric_B_Meyer) and Casey Snipe (@CLSEmployerLaw) sat down with me for a 25 minute Q&A session where we tackled a handful of questions from our Triple Threat webinar.

FMLA Eligibility & Intermittent Leave

Eric and Casey shared with us how to handle casual comments about medical conditions from employees. When are employers obligated to start the ADA and FMLA processes? They also tackle the very complicated subject of intermittent leave. Who notifies who? Is it retroactive and can I offer FMLA if I have less than 50 employees? We titled the webinar the Triple Threat because these three topics: FMLA, ADA and Workers’ Compensation are often intertwined together. HR practitioners need to be well-versed and educated on these three particular areas of employment law as they do evolve and change. Casey and Eric mention a number of important cases that are changing the game. This podcast episode discusses several situations and scenarios where the three laws mix and mingle.
